Subdividing your land

Subdivision is the process of dividing land or an existing building into two or more lots. Each lot then has a separate title and can be sold separately.

How to subdivide your land?

The subdivision of land requires a planning permit and is the first step in the process of obtaining new titles for subdivided land.

Step 1.Apply for a planning permit

With the exception of minor boundary realignments and consolidation of land, all types of subdivision require a planning permit.

Step 2.Certification of plan of subdivision

Once a planning permit has been issued, the plan of subdivision must be certified.

To subdivide you need to engage a licensed land surveyor to prepare a plan of subdivision to submit with your certification application.

Licensed land surveyors are the only people qualified in Victoria to determine the location of your title boundary and create new title boundaries. You can find a land surveyor on the Consulting Surveyors Victoria website at www.acsv.com.au.

Certification applications in SPEAR

Certification applications are managed on the SPEAR platform, which is an online system that allows certification applications to be lodged, managed, referred, approved and tracked online.

Your land surveyor will submit the certification application on your behalf through the SPEAR application portal at www.spear.land.vic.gov.au.

Step 3.Make payment

If you are a registered land surveyor you can pay the certification application using a credit card.

You will need the SPEAR reference which is 8 digit reference that starts with ‘S’.

Step 4.Statement of Compliance

This is the final step in the subdivision process which is finalised in the SPEAR application portal, and is issued once all planning permit and referral authority requirements have been met.

The Titles Office will give you a new Certificate of Title once you have a Statement of Compliance.
